Please find below the Terms and Conditions set out by the Company, which are governed by the laws of the Sultane of Oman. In the Terms and Conditions detailed in this document, “we”, “us”, and “our” refers to Oasis Incentives and Tours LLC. All references to “you” and “your” indicate all persons named on the booking (as well as those that may be added/substituted at a later stage) unless stated otherwise.
Please read the following Terms and Conditions carefully.
BOOKING INFORMATION
Once a proposed itinerary and its pricing have been accepted, you will be expected to send us a deposit of at least 25% or any other amount as advised by us in order to confirm the trip and your arrangements. If you book within 60 days of the date of arrival, then a full payment would be required to confirm your trip. Failing to comply with these payment terms, may result in a cancellation of your trip by us.
A binding agreement between you and us comes into existence upon receipt of the deposit or full payment if applicable, and by making the required payment, you are deemed to have accepted these Terms and Conditions, on behalf of yourself as well as all the members of your traveling party including those who may be added/substituted at a later stage.
Amendments and Cancellations
Amendments
Amendments by You
Once the deposit or full payment if applicable is received, services offered as per the itinerary will be booked. Should you wish to alter the itinerary after this point, we will make every effort to assist, however, we cannot guarantee that such amendments can be confirmed, and charges may apply.
Please ensure to write to us to request any amendments to your booking as verbal requests will not be actioned.
If any member of your party is unavoidably prevented from traveling, we would not object to someone else taking their place. However, please note, some suppliers for e.g., airlines consider any change of name on a booking as a cancellation, and as such, a cancellation fee would be chargeable, in addition to the booking fees applicable for the substituted passenger.
Amendments by Us
In the unlikely event that we will have to make changes to the services confirmed by us, we reserve the right to do so at any time. We make these arrangements many months in advance and occasionally alterations to your tour (e.g., excursions, planned meals, accommodations, or other travel arrangements) may occur for reasons beyond our control. We strive to advise you at the earliest in the event we make amendments to the itinerary.
Cancellations
Cancellations are effective from the day they are received by us in writing, verbal requests will not be entertained.
Costs are incurred from the moment your booking is confirmed. As such, the cancellation charges payable to us would be dependent on how many days prior to arrival the cancelation request is received and informed to you with our quotation.
In circumstances where travel arrangements are curtailed or amended after departure due to Force Majeure, we will endeavour to do our best to recover and refund to you as much as possible.
Visa Applications, Processing & Cancellations
Every applicant is responsible for conforming with and fulfilling any requirements stated by the authority.
Oasis Incentives and Tours LLC will not accept responsibility if an applicant is not eligible for the services requested, for incorrect/incomplete information provided by the applicant, for failure to provide supporting documents as and when required, or for any similar errors in relation to any services offered.
If there should be a change in the pricing of a given service or product requested by an applicant then management shall review that, if additional costs are required then the applicant will be liable to settle to disbursement, alternatively if there is a decrease then management may decide to refund any such difference.
In certain cases, documentation, services, or Visa fees include 3rd party charges.
Requirements and fees related to the processing of Visas & Immigration services, offered by us are subject to change without prior notice.
We reserve the right to decline processing of documents, services or Visa services for any reason, including but not limited to incomplete documentation, insufficient processing time, or unusual circumstances.
We reserve the right to cancel payments or orders prior to the commencement of the delivery, without stating any reasons for the same.
Where the applicant has received either the document list, supporting letter templates or consultation from our team it is considered that our consultation services have started, and management will use their discretion as to the refund amount.
Processing time for documents, services quoted by Oasis Incentives & Tours LLC are approximate and based on processing times provided by various Government departments, suppliers, Consulates or Embassies under normal circumstances.
Although we endeavour to always try and meet our customer’s needs and requests, there may, from time to time, delays. Because of this, processing times quoted are offered in the context of expected rather than guaranteed times, on the understanding there may be occasional delays caused by unforeseeable circumstances.
Force Majeure
We cannot accept liability or pay any compensation where the performance or prompt performance of our obligations with you is prevented or affected by you otherwise suffer any damage or loss as a result of "force majeure". "Force Majeure" means any event or circumstances which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events or circumstances are likely to include but are not limited to, actual or threatened war, riot, civil strife, terrorist activity, industrial dispute, technical problems with transport, machinery or equipment, power failure, natural or nuclear disaster, fire, flood, drought, adverse weather conditions (including snow or lack thereof) and level of water in rivers, lakes, and reservoirs.
Covid-19 Acknowledgment
You must provide the relevant health documentation to travel and agree to comply with all health protocols set in place during your journey. Noncompliance with these measures will result in not being able to travel or continue on the journey. You voluntarily assume all risks and related expenses in the event that you or any member of your traveling party require testing or quarantine, become infected with COVID-19, or experience travel interruptions or delays.
Our Prices
Pricing based on the itinerary is on a per person basis unless specified otherwise. We are under no obligation to give you a breakdown of said costs.
Any modifications to the proposed itinerary e.g., number of guests traveling or dates of travel, would require a revised itinerary and pricing.
Our costs are based on current prevailing taxes. We reserve the right to amend our pricing to include any revision to said taxes. In the event, there is a tax revision, an amended pricing sheet reflecting new pricing will be sent to you.
We reserve the right to make changes to and correct errors in prices at any time before your booking is confirmed.
Should you instruct your credit card company to “charge back” any payment(s), a fee of $100 per incident and associated costs will be charged. We further reserve the right to cancel your booking and/or take legal action against you for all outstanding payment(s).
Inclusions
All airport and hotel transfers, transport, and sightseeing (as offered in the itinerary) with a local English-speaking guide, accommodations, meals (as indicated in the itinerary), entrance fees, mineral water stored in the vehicle, and all applicable taxes & VAT, unless otherwise stated.
Exclusions
Internal (offered separately as a supplement) or international air costs associated with obtaining passports or entry visas, border fees, airport departure taxes, unless otherwise noted; excess baggage charges; all gratuities; porterage, meals other than those specified in the itinerary; room service; beverages other than those noted in inclusions above or specified in the itinerary; any meals for your guide if you invite him/her to dine with you; sightseeing not included in the itinerary; and personal expenses such as laundry, communication charges, and optional activities (which are subject to availability).
Special Requests
Any special requests should be indicated in writing. We will do our best to acquiesce to these special requests but cannot guarantee that they will be confirmed, nor will we be liable if any special request is not met unless the request relates to a medical condition or disability, and we specifically confirm it will be met in writing. Please note - confirmation that a special request has been noted or passed on to the supplier or the inclusion of the special request on your confirmation invoice or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability.
IMPORTANT INFORMATION
Passports & Visas
It is your sole responsibility to obtain and have the necessary and valid travel documents. We advise you to check with the appropriate government authority to determine the documents required for travel. A passport with at least 6 months validity is required when traveling to the Sultane of Oman, and should contain sufficient blank pages for entry and exit visa stamps.
All travellers should abide by the entry requirements pertaining to their journey. You may be refused boarding or disembarked without liability for refund, payment, compensation, or credit of any kind if you do not have proper documentation. You will also be subject to any fine or other costs incurred by us due to improper documentation or noncompliance with applicable regulations. We shall not be held responsible in the event you are denied entry to a country due to non-compliance with these requirements.
Health
We advise that you contact your doctor/public health advisory prior to the date of travel, for all medical advice.
Your itinerary may include visiting high altitude areas and extreme adventure activities. For expectant mothers and those who suffer from circulation, heart, or respiratory problems, we advise that you consult with your doctor before confirming your booking.
Travel Insurance
Travel insurance is not included in the price of your trip and is strongly recommended. It is advisable to obtain travel insurance at the time of booking your trip, should you have to cancel for an insured reason such as illness or serious accident. We recommend that you and all members of your party are adequately insured, providing financial protection against unforeseen circumstances. The cover should include medical expenses, as well as repatriation, in the event of an accident or illness. In addition, we recommend that you have cover for personal belongings, delay at your outward or homeward point of departure, personal liability, overseas legal expenses, and cancellation. If you are undertaking any sports or adventurous activities on your trip, including trekking, you should also make sure that your policy covers these. Please also ensure you read the policy conditions and exclusions before signing with a travel insurance provider.
Air
All internal air is based on economy class seating (unless another class is requested) and is 100% non-refundable (some exceptions may apply). Flight confirmation is based on availability. Tickets cannot be confirmed until we receive a passport copy.
All air carriers are independent contractors and are not owned, managed, controlled, or operated by us. Your airline ticket constitutes a contract between yourself and the airlines (and not us), even if purchased through us. We shall not be liable and do not assume responsibility for, or accept claims with regard to, seat assignments, name changes, schedule changes, flight changes, and/or cancellations. All airline change and cancellation fees will apply if you change or cancel your air transportation arrangements before or after your travel begins.
Hotel
Most hotels allow check-in to take place during the mid-afternoon. A request for early check-in based on hotel availability cannot be guaranteed and is at the sole discretion of the hotel.
Extra beds placed in a room would be subject to the hotels' own respective policies. Twin bedded rooms are subject to availability and every effort will be made to confirm the same, however, on some occasions, rooms with one double bed may be the only option available.
Specific requests such as adjacent or connecting rooms, bedding requests, smoking rooms, and special dietary needs should be advised at the time of booking. Please note that reasonable efforts will be made to secure special requests; however, they cannot be guaranteed.
Excursions, Spa Appointments & Restaurant Bookings
Please note that when we book an excursion, spa or restaurant locally on your behalf, you contract with the local company providing that service and not us. We have no legal liability for anything that may go wrong and any claim that you might have arising out of anything that goes wrong will be against the relevant local company and subject to the local company’s terms and conditions.
Miscellaneous
You agree that if you are injured or become ill, we may, at your cost, attempt to arrange medical treatment, evacuation or any other emergency services on your behalf as it deems essential for your safety and well-being, but it accepts no responsibility for the quality or adequacy of any such treatment, evacuation or services. Baggage is carried entirely at your risk. We reserve the right to remove anyone from a trip without refund who acts in a manner which it considers unsafe or inconsiderate to fellow travellers or others and/or who ignores the requests of his or her guide(s) to act in a safe and considerate manner.
FURTHER INFORMATION
Complaints
If you have a problem during your travel, please inform our local representative or your guide immediately and they will endeavour to put things right. If your problem cannot be resolved locally, we request you to send an email to us at: info@oasis-incentives.com elaborating on the situation. We request that you do this at the earliest, as waiting will deprive us of the opportunity to investigate and rectify the problem.
Data Collection
In order to process your booking, we need to collect certain personal details from you. These details will usually include the names and addresses of party members, passport information, credit/debit card or other payment details, and special requirements such as those relating to any disability or medical condition which may affect the chosen travel arrangements and any dietary restrictions which may disclose your religious beliefs.
We need to pass on your personal details (normally your full name, passport details and contact number) to the companies and organizations who need to know them so that your arrangements can be provided (for example your airline, our own local offices, hotels, etc.).
By providing this information to us you consent to our holding, using and passing on in connection with your travel arrangements the information you give us (including details relating to your physical or mental health or condition and any religious beliefs) unless you tell us otherwise in writing.
Security
We reserve the right from time to time to: (a) alter and/or introduce new and/or additional security measures without notice; (b) temporarily withdraw and/or limit the availability of this site to any individual(s); and (c) do anything else that we believe necessary to preserve the security and integrity of this site and the information held in this site's databases.
Accuracy & Website Content
We use reasonable skill and care in compiling the information accessible on and through this site. However, certain information may have been compiled and/or provided to us by a third party who is not a member of our network. We do not accept responsibility for the accuracy of any information which is obtained from any such third party. Furthermore, errors and omissions in the information accessible on and through this site may occur because of a number of factors which are inherent in any internet-related system, and which are not within our reasonable control. Law
Use of this website and the Service is governed by the Sultanate of Oman law, and you irrevocably agree to submit any claim or dispute arising in relation to, out of, or in connection with this site (and any use you make of it or the Service and/or opportunities offered through it) to the non-exclusive jurisdiction of the Sultanate of Oman courts.
The above booking terms and conditions together with all correspondence form part of your contract with us i.e., Oasis Incentives and Tours LLC. This contract and any matters arising from it shall be governed by and interpreted in accordance with the laws of the Sultanate of Oman.
